PSC Updates Misty Water Works Hearing Schedule

JEFFERSON CITY---The Staff of the Missouri Public Service Commission (PSC Staff) has filed a petition with the Public Service Commission (Commission) asking the Commission to direct its General Counsel to petition Cole County Circuit Court to appoint a receiver for the Misty Water Works water system in Pulaski County. The PSC Staff has also asked the Commission to appoint an interim receiver for the water system.

The Commission has set an evidentiary hearing for October 25, 2023, at 9:00 a.m., in Room 310 of the Governor Office Building, 200 Madison Street, in Jefferson City, Missouri. This building meets accessibility standards required by the Americans with Disabilities Act. On April 10, 2023, the PSC Staff filed a complaint (Case No. WC-2023-0353) against Leon Travis Blevins and Patricia Blevins d/b/a Misty Water Works a/k/a Misty Water Works, Charity PWS and Roling Hills PWS for allegedly operating a public utility without certification or other authority from the Commission. On June 12, 2023, Mr. Blevins requested and received from the Commission a 90-day extension of time to answer the PSC Staff complaint.

On June 13, 2023, Mr. Blevins filed an application (Case No. WA-2023-0418) with the Missouri Public Service Commission seeking a certificate of convenience and necessity (CCN) to construct, install, own, operate and maintain water systems in Pulaski County near St. Robert, Missouri. According to the application, the requested area generally encompasses an existing development (Misty Water Works) whose water systems are not currently regulated by the Missouri Public Service Commission. The application states that there are approximately 100 residential connections being served by the water systems.

On August 15, 2023, the PSC Staff filed a petition with the Commission seeking appointment of an interim receiver, alleging that it was “due to an inability or unwillingness of Misty Water Works to provide safe and adequate service,” said the PSC Staff. The PSC Staff alleges Leon Travis Blevins d/b/a Misty Water Works owns, operates and is responsible for a public water system or systems serving approximately 100 customers. According to the PSC Staff petition, these are wells and drinking water systems in and around the St. Robert, Waynesville, Dixon, Devil’s Elbow and Richland, Missouri area in Pulaski County.

The PSC Staff complaint case and the Misty Water Works CCN application case are currently before the Commission.
