Utility Tariffs for Large Load Customers in Missouri

In 2025, Senate Bill 4 was passed by the General Assembly and signed by Governor Kehoe. It required the Missouri Public Service Commission (PSC) to adopt rates for large load customers ­— including data centers — that reflected those customers’ share of their costs and prevented other customers ­— like residential and commercial customers — from being charged any unjust or unreasonable costs arising from service to large load customers. Two of Missouri’s three regulated electric utility companies, Ameren Missouri and Evergy, have approved large-load tariffs. Liberty Utilities’ large load tariff case is currently in progress.

In its approval of large load tariffs, the PSC adopted provisions designed to protect residential and small-business customers from costs related to data centers, including: 

  • Minimum Service Contracts. Large-load customers must take service for a minimum of 12 years, with the option of taking an additional 5 years as a “ramp up” period until fully using their projected amount of energy, for a potential 17-year commitment. 
  • Financial Security and Collateral Requirements. Large load customers must meet creditworthiness and liquidity requirements as well as provide collateral in the amount of two years of minimum monthly bills. 
  • Exit and Early Termination Fees . Large-load customers may terminate or change rate schedules before the end of the contract term if written notice is provided at least 24 months prior to the requested change taking effect. In those instances, the customer will be subject to an exit fee. If requesting to terminate with less than 24 months’ notice, the customer is also subject to an early termination fee. 
  • Minimum Monthly Bill. Each large-load customer bill will include the sum of all applicable charges, including a monthly demand charge set at 80% of the agreed upon rate.
  • Cost Stabilization Recovery. This requirement ensures that the electric utility can recover all costs associated with serving large load customers and that large load customers are paying their full cost of service.
  • Optional Renewable and Carbon-Free Programs. Large-load customers have the option to invest in additional generation and capacity programs, including nuclear and clean energy programs, at their own expense.
