On October 30, 2014, Kansas City Power & Light Company (“KCP&L”) submitted a tariff designed to implement a general rate increase for electric utility service. In an order issued on December 12, 2014, the Commission established a procedural schedule, but declined to rule on two hypothetical disputed issues in the proposed procedural schedule submitted by some of the parties: (1) conditional procedural schedules if there are delays in placing the La Cygne Environmental Project in-service, and (2) footnote 2 in the proposal regarding possible delays in meeting in-service criteria for that project.
On December 19, 2014, KCP&L filed a Motion for Reconsideration of Procedural Schedule, asking the Commission to add to the current procedural schedule the date of May 1, 2015 as the deadline after which the Commission will not consider a KCP&L request for Commission approval of either a 30-day or 60-day extension of the schedule and to reserve the alternative conditional hearing dates in the proposed procedural schedule in the event KCP&L requests and the Commission approves those extensions. KCP&L represents that Staff does not oppose this motion. On December 24, 2014, the Office of the Public Counsel filed a response opposing the motion.
After considering the arguments of the parties, the Commission concludes that KCP&L’s request to add a deadline of May 1, 2015 as the last day to request amendment of the procedural schedule is reasonable. Although presented as a motion for reconsideration of a previous order, it does not allege that the previous order was unjust, unlawful, or unreasonable, so the Commission will consider the motion a request to amend the procedural schedule. Therefore, the Commission will grant the motion and reserve dates on the adjudication calendar in the event KCP&L requests and the Commission grants an extension to the procedural schedule. However, by granting this motion the Commission is not indicating, directly or indirectly, whether it would grant or deny such a future motion to extend the procedural schedule and is not ruling on any potential dispute regarding the matters described in footnote 2 of the proposed procedural schedule.
THE COMMISSION ORDERS THAT:
1. Kansas City Power & Light Company’s Motion to Amend Procedural Schedule is granted.
2. The procedural schedule is amended to include May 1, 2015 as the last day to request an amendment to the procedural schedule. All provisions of the existing procedural schedule remain in effect.
3. This order shall be effective when issued.
