Tariff to Extend DSM Programs ) Tariff No. JG-2013-0479
ORDER APPROVING EXPEDITED TARIFF

On April 24, 2013, The Empire District Gas Company issued a tariff to extend the Home Performance with Energy Star Program. That tariff carries a thirty-day effective date of May 24. However, Empire Gas filed a motion along with its tariff asking the Commission to expedite its approval of the tariff so that it can go into effect on May 12.
Empire Gas explains that the tariff sheet in question was intended to be a part of a series of tariff sheets issued on April 12, to be effective on May 12. Since Empire Gas failed to file this tariff sheet along with its companions, the sheet can only become effective at the same time as the companion tariff sheets if the Commission approves it to take effect in less than thirty days. On May 3, Staff filed its recommendation advising the Commission to approve the tariff to be effective on May 12. No other party has filed a recommendation regarding the tariff.
Section 393.140(11) RSMo 2000 authorizes the Commission to approve a tariff to become effective on less than thirty-day’ notice upon a showing of good cause. Based on Staff’s recommendation, the Commission finds good cause and will approve Empire Gas’ tariff to be effective on May 12, 2013.
THE COMMISSION ORDERS THAT:
1. The Empire District Gas Company’s Tariff No. JG-2013-0479 is approved to become effective on May 12, 2013. The specific tariff sheet approved is:

1st Revised Sheet No. R-51i, Canceling Original Sheet No. R-51i
2. This order shall become effective on May 12, 2013.
3. This file shall close on May 13, 2013.
