PR-10-139 -- PSC Grants Request To Rescind Sewer Certificate

FOR IMMEDIATE RELEASE -- FEBRUARY 5, 2010

JEFFERSON CITY---The Missouri Public Service Commission has granted a motion for dismissal of application and for rescission of a conditional grant of a certificate of public convenience and necessity filed by the Timber Creek Sewer Company (Timber Creek).  As a result, Timber Creek will not be providing sewer service to the Timber Springs Estates Subdivision near Trimble, Missouri. 

On December 2, 2009, the Commission approved a request filed by Timber Creek which sought Commission authority to extend its current service area to provide sewer service to the Timber Springs Estates Subdivision near Trimble.  The certificate was granted subject to certain conditions which included finalizing a contract to transfer a collection system and wastewater treatment plant owned by the Timber Creek Homes Association to Timber Creek.

To meet the conditions, Timber Creek reached an agreement with the association’s governing body.  However, the association’s membership did not approve the agreement, so Timber Creek will not be able to meet the conditions.  As a result, Timber Creek sought rescission of the certificate, which the Commission has granted.
