PR-11-81 -- PSC Approves Electric Territorial Agreement

FOR IMMEDIATE RELEASE -- NOVEMBER 26, 2010

JEFFERSON CITY---The Missouri Public Service Commission has approved a territorial agreement between The Empire District Electric Company (Empire) and Ozark Electric Cooperative (Ozark) which establishes separate exclusive service territories for Empire and Ozark for new structures in and near the City of Clever in Christian County.

The joint application stated the territorial agreement will not require the transfer of any facilities or customers. The application stated the establishment of exclusive service territories will prevent future duplication of electric service facilities, will allow electric service customers within the area to know with certainty the supplier of their electric service and will allow the applicants to avail themselves of prior investment and planning for serving the public.

In a memorandum filed with the Commission on November 5, 2010, the PSC staff recommended the application be approved.

Based upon a review of the application and the PSC staff recommendation, the Commission determined the territorial agreement is not detrimental to the public interest and should be approved.
