ORDER TO SUPPLEMENT APPLICATION

The application seeks authorization for a transfer of assets. In compliance with the governing statute,[1] the application alleges that the transfer sought will not affect the tax revenues of any political subdivision. [2] Neither those political subdivisions nor the counties in which those political subdivisions lie (“affected political subdivisions”) are listed in the application. The commission’s regulations do not require that information. Nevertheless, the counties containing affected political subdivisions are due notice under the same statute:

The commission shall send a copy of all information obtained by it as to what . . . impact such [transaction] will have on the tax revenues of various political subdivisions to the county clerk of each county in which any portion of a political subdivision which will be affected by such disposition is located. [[3]]

 

Some political subdivisions may cross county lines so the Commission’s duty is to send information to the clerks of counties, not only where the assets are located, but where any affected political subdivision is located. Therefore, the Commission will order the application supplemented.

THE COMMISSION ORDERS THAT:

1.     No later than August 10, 2015, the applicants shall file a supplement to the application listing each county in which an affected political subdivision, as described in the body of this order, is located.

2.     This order shall be effective when issued.
