ORDER
DISMISSING COMPLAINT
WITHOUT
PREJUDICE

Cloris and Ronald Torrey (Complainants) filed a complaint challenging Laclede Gas Company’s request to enter their home in order to perform a safety inspection. Laclede filed a motion to dismiss the complaint. In its motion, Laclede informed the Commission that the complaint has been settled.[1] The Commission directed Complainants to file a statement by April 17, 2015, with the Commission verifying Laclede’s information. Complainants failed to respond to the Commission’s order.
Under Commission rule 4 CSR 240-2.116(3), a party may be dismissed from a complaint for failing to respond to a Commission order. Complainants have failed to respond to the Commission’s order directing them to file a statement of whether this complaint has been settled. The Commission will therefore dismiss this complaint
Because this complaint is not being dismissed on the merits of the complaint, but rather on procedural grounds, Complainants may refile the complaint; in which case it will be assigned a different case number.
THE COMMISSION ORDERS THAT:
1. This complaint is dismissed.
2. This order shall become effective on May 29, 2015.
3. This file shall be closed on May 30, 2015.
