ORDER DISMISSING COMPLAINT

WITHOUT PREJUDICE

Ullesseyo Whitehorn (Complainant) filed a complaint against Union Electric Company d/b/a Ameren Missouri alleging the company improperly billed her for a tenant’s debt.  The Commission set a prehearing conference[1] and Complainant failed to appear. The Commission then set a second prehearing conference[2] and Complainant again failed to appear.

Under Commission rule 4 CSR 240-2.116(3), a party may be dismissed from a case for failure to appear at a prehearing conference.  Complainant has twice failed to appear for prehearing conferences.  The Commission will therefore dismiss this complaint.  Because this complaint is not being dismissed on the merits of the complaint, but rather on procedural grounds, Complainant may refile the complaint; in which case it will be assigned a different case number. 

THE COMMISSION ORDERS THAT:

1.               This complaint is dismissed.

2.               This order shall become effective on May 29, 2015.

3.               This file shall be closed on May 30, 2015.
