ORDER GRANTING LEAVE TO DISMISS

On March 27, 2014, The City of Houston Lake, Missouri (“Houston Lake”) filed the above-styled complaint.   Houston Lake, Missouri-American Water Company (“MAWC”) and the Staff of the Commission (“Staff”) filed a Stipulation of Dismissal on March 24, 2015.

Commission Rule 4 CSR 240-2.116(1) states that once prepared testimony has been filed, a complainant may dismiss an action only by leave of the Commission, or by written consent of all the parties.[1]  Houston Lake and MAWC filed prefiled testimony.  Thus, leave of the Commission is needed for Houston Lake to dismiss this complaint. 

The Stipulation of Dismissal states that Houston Lake and MAWC have settled the complaint to their mutual satisfaction.  Also, Houston Lake, MAWC, and Staff all consent to the dismissal.  The Commission, therefore, will grant Houston Lake leave to dismiss the complaint.  This file shall be closed.

THE COMMISSION ORDERS THAT:

1.               The City of Houston Lake is granted leave to dismiss the above-styled complaint.

2.               This order shall be effective when issued.

3.               This file shall be closed on March 26, 2015.
