ORDER GRANTING MOTION TO PROVIDE ADDITIONAL NOTICE

AND OPPORTUNITY TO INTERVENE

On October 30, 2014, Kansas City Power & Light Company (“KCP&L”) submitted a tariff designed to implement a general rate increase for electric utility service.  The Commission issued notice of the filing to the county commissions, media and General Assembly members for KCP&L’s service area.  

On February 19, 2015, the Staff of the Commission filed a motion to provide additional notice and opportunity to intervene to the signatories to a stipulation and agreement filed on March 28, 2005 in File No. EO-2005-0329.  Staff alleges that the stipulation and agreement contained a provision preventing KCP&L from utilizing riders, surcharges, or changes in rates outside of a general rate case, such as a fuel adjustment clause, prior to June 1, 2015.  Staff states that since KCP&L seeks to implement a fuel adjustment clause in this rate case, the signatories to the stipulation and agreement who are not already parties to this case should be provided with specific notice of the KCP&L request and an opportunity to intervene in this matter.  The signatories identified by Staff are the Missouri Department of Natural Resources, Ford Motor Company, KCP&L Greater Missouri Operations Company, The Empire District Electric Company, and the Missouri Joint Municipal Electric Utility Commission.

On March 2, 2015, KCP&L filed a response to the motion arguing that notice was adequate for the fuel adjustment clause request and that Staff’s motion is based on incorrect assumptions.  However, KCP&L states that it does not object to providing additional notice if deemed necessary by the Commission.  The Commission finds the motion reasonable and will grant it.  However, the Commission will not address at this time Staff’s request to limit intervention to issues related to the stipulation and agreement.  That request should be presented in response to any future applications to intervene that may be filed.

THE COMMISSION ORDERS THAT:

1.               Staff’s motion to provide additional notice and opportunity to intervene is granted.

2.               The Commission’s Data Center shall send a copy of this order to the Missouri Department of Natural Resources, Ford Motor Company, KCP&L Greater Missouri Operations Company, The Empire District Electric Company, and the Missouri Joint Municipal Electric Utility Commission.

3.               Any of the entities provided notice in this order that wish to intervene in this matter shall file an application to intervene no later than March 17, 2015.

4.               This order shall be effective when issued.
