On February 27, 2015, Missouri-American Water Company filed
a petition asking the Commission to promulgate a new regulation to establish
procedures for creation of a revenue decoupling mechanism for the water and
sewer industry. Section 536.041, RSMo (Cum.
Supp. 2013) requires the Commission to respond to Missouri-American’s petition
within 60 days. If the Commission
decides to grant that petition, it would then undertake the formal rulemaking
process mandated by Chapter 536, RSMo.
Before deciding whether to grant Missouri-American’s
petition, the Commission will direct its Staff to investigate that petition and
provide the Commission with its recommendation.
As this is not a contested case, anyone else may offer a recommendation
regarding Missouri-American’s petition without the need to apply to intervene.
THE COMMISSION ORDERS
THAT:
1. Staff shall
investigate Missouri-American Water Company’s Rulemaking Petition and shall, no
later than April 1, 2015, recommend whether the Commission should proceed with
a rulemaking.
2. Any other
person or entity wishing to offer a recommendation regarding Missouri-American
Water Company’s Rulemaking Petition shall file a written comment no later than April
1, 2015.
3. This order
shall be effective when issued.
