ORDER SHORTENING TIME TO RESPOND TO PROPOSED PROCEDURAL SCHEDULE TO CONSIDER A REDUCED RATE FOR NORANDA

On October 15, 2014, the Missouri Retailers Association, the Office of the Public Counsel, the Consumers Council of Missouri, and the Missouri Industrial Energy Consumers (MIEC) filed a proposed procedural schedule by which they would have the Commission consider their nonunanimous stipulation and agreement to give Noranda Aluminum a reduced electric rate.   The proposed schedule would have the parties file direct testimony on October 24, and would lead to an evidentiary hearing on November 24 and 25.  By rule, parties are allowed ten days to respond to any pleading unless otherwise ordered by the Commission.[1]  That means, responses are due by October 25, unless the Commission establishes a different response date.

On October 20, Public Counsel, the Retailers Association, MIEC, and Consumers Council filed a motion asking the Commission to expedite its consideration of the proposed procedural schedule to allow that schedule to be approved on October 22.  If the Commission is to consider the proposed procedural schedule at its October 22 agenda meeting it will need to have responses from the other parties before that date.  Therefore, the Commission will establish a shortened time for the filing of responses to the proposed procedural schedule.  

THE COMMISSION ORDERS THAT:

1.       Any party wishing to offer a response to the Motion to Adopt Jointly Proposed Procedural Schedule for Consideration of Nonunanimous Stipulation and Agreement shall do so no later than 4:00 p.m. on October 21, 2014.

2.       This order shall be effective when issued.
