ORDER REGARDING TIME TO RESPOND TO AMEREN MISSOURIíS MOTION TO DISMISS COMPLAINT

††††††††† On March 17, 2014, Union Electric Company, d/b/a Ameren Missouri filed a motion asking the Commission to dismiss the complaint brought by Noranda Aluminum and multiple other customers alleging that Ameren Missouri is overearning and seeking to reduce the rates the companyís general rates.Commission rule 4 CSR 240-2.080(13) provides that parties are allowed ten days from the date of filing to respond to any pleading unless the Commission establishes some other time for response.Thus, the rule requires that responses to Ameren Missouriís motion to dismiss complaint are to be filed by March 27.

That is an appropriate response time and will allow for responses to be filed before the procedural conference that has been scheduled for March 28.†††††

THE COMMISSION ORDERS THAT:

1.               Any party wishing to respond to Ameren Missouriís Motion to Dismiss Complaint shall do so no later than March 27, 2014.
