ORDER GRANTING REQUEST FOR EXPEDITED TREATMENT AND SUSPENDING TARIFF

On July 19, 2013, Kansas City Power & Light Company (“KCP&L”) and KCP&L Greater Missouri Operations Company (“GMO”) submitted revised Economic Development Rider (“EDR”) tariffs to the Commission. KCP&L seeks to freeze current EDR tariff Nos. 32, 32A, 32B, 32C, and 32D for its customers currently on an EDR tariff under contract and establish new EDR tariff Nos. 32E, 32F, 32G and 32H. GMO also seeks to freeze its currently active EDR tariff Nos. 120, 121, 122, and 123 for those customers currently on an EDR tariff under contract. GMO also proposes new EDR tariff Nos. 123.1, 123.2, and 123.3. Unless the Commission acts to suspend the EDR tariffs for both KCP&L and GMO, they will become effective on August 18, 2013.

On August 9, 2013, the Office of the Public Counsel filed a Motion to Suspend Tariffs and Motion for Expedited Treatment. In its motion, Public Counsel states that it submitted approximately two dozen data requests to KCP&L and GMO, for which responses are not due until the last week of August. Public Counsel states these data requests are necessary to assess the cost-effectiveness, protections against free riders, and potential for discriminatory rate treatment under the revised EDR tariffs. Pursuant to 4 CSR 240-2.080(14), Public Counsel seeks Commission action prior to the effective date of August 18, 2013.

Given the imminent effective date of the tariffs, the Commission finds good cause to grant Public Counsel’s Motion to Suspend Tariffs and Motion for Expedited Treatment. The Commission will suspend the tariffs for 120 days, as authorized by Section 393.150.1, RSMo 2000.

THE COMMISSION ORDERS THAT:

1.               The Office of Public Counsel’s request for expedited treatment is granted.

2.               The tariff submitted on July 19, 2013, by Kansas City Power & Light Company under Tariff File No. JE-2014-0026, is suspended until December 12, 2013, unless otherwise ordered by the Commission:
