ORDER APPROVING UNANIMOUS DISPOSITION
AGREEMENT

On September 19, 2012, Seges Partners Mobile Home Park, LLC (“Seges Partners”)[1] initiated a small company revenue increase request pursuant to Commission Rule 4 CSR 240‑3.050. On February 19, 2013, the Commission’s Staff filed a Unanimous Disposition Agreement (“Agreement”) executed by it, Seges Partners and the Office of the Public Counsel.
The Agreement would increase Seges Partners’ annual revenue requirement $3,534. The total bill increase would be 11.49%, or $5.82 monthly per customer.
The Commission finds the Agreement reasonable and shall approve it.[2] The Commission notes that Seges Partners has already filed tariffs bearing an effective date of April 8, 2013, in an effort to comply with the Agreement. Thus, the Commission will order its Staff to file a Recommendation.
THE COMMISSION ORDERS THAT:
1. The Unanimous Disposition Agreement regarding, Seges Partners Mobile Home Park, LLC request for an increase in sewer revenue, File No. SR-2013-0112, entered into by Seges Partners Mobile Home Park, LLC, the Staff of the Missouri Public Service Commission and the Office of the Public Counsel, is approved.
2. The signatories shall comply with the terms of the Unanimous Disposition Agreement. A copy of the Agreement is attached to this order as Appendix A.
3. The Staff of the Commission shall file a Recommendation on the tariffs filed by Seges Partners Mobile Home Park, LLC no later than March 27, 2013.
4. This order shall become effective March 9, 2013.

[1] Seges Partners serves approximately 58 residential customers in its certificated service area.
[2] The Commission has the legal authority to accept stipulations and agreements as offered by the parties pursuant to Section 536.060, RSMo 2000. The requirement for a hearing is met when the opportunity for hearing has been provided and no proper party has requested the opportunity to present evidence. State ex rel. Rex Deffenderfer Enterprises, Inc. v. Public Service Commission, 776 S.W.2d 494, 496 (Mo. App. 1989).
