APPROVING UNANIMOUS
DISPOSITION
AGREEMENT AND APPROVING TARIFF

On May 30, 2012, House Springs Sewer Company filed with the Missouri Public Service Commission a request to increase its annual sewage operating revenues by $125,000. The company provides sewer service to approximately 1,178 customers. On February 7, 2013, the parties[1] filed a Unanimous Disposition Agreement. Staff also filed notice of the agreement on the same day, and filed an amendment to that notice on February 14 to inform the Commission that the company is delinquent in the payment of a portion of its 2011 assessment and all of its 2012 and 2013 assessment. Staff states that the company has made arrangements to pay these delinquencies.
The Agreement provides for a $133,654 increase in the company’s annual operating revenues. The current and agreed upon rates are as follows:

The parties agreed upon a number (22) of conditions; the following of which the Commission particularly notes:
· Return on Equity of 12.15%
· Within 30 days of the effective date of this order, the company shall provide a written plan to Staff outlining the replacement of 38 UV bulbs
· Within 90 days of the effective date of this order, the company shall provide monthly reports to Staff detailing how many UV bulbs were replaced at each plant.
· The company’s rates resulting from the Agreement will include an amount of $22,850 for sludge hauling expense; of note: the company pays the city of Byrnes Mill to haul sludge
· Within 90 days of the effective date of this order, the company shall implement Staff’s recommendations concerning alternatives for sewage treatment in an effort to reduce the cost of sludge hauling
On February 13, the company filed a proposed tariff sheet consistent with the Agreement. The tariff sheet has an effective date of March 15.
Upon review of the Agreement, the Commission finds that the terms and obligations set out in the Agreement are reasonable. The Commission will therefore approve the Agreement and direct the parties to abide by the terms set out therein. The Commission will also approve the tariff to become effective on March 15, 2013.
THE COMMISSION
ORDERS THAT:
1. The Unanimous Agreement Regarding Disposition of Small Sewer Company Revenue Increase Request is approved.
2. The signatories to the Agreement shall comply with the terms set out therein.
3. The proposed tariff sheet, filed by House Springs Sewer Company on February 13, 2013 and assigned Tariff No. YS-2013-0359, is approved to become effective on March 15, 2013.
4. The following tariff sheet is approved:

5. This order shall become effective on March 15, 2013.
6. This case shall be closed on March 16, 2013.
