On November 16, 2014, George M. Hall applied to intervene out of time. In response to that motion, the Commission ordered that any party wishing to respond to the application to intervene do so no later than November 20, at 11:00 a.m. In that order, the Commission remarked that it intended to rule upon the application to intervene before the local public hearing on November 24.
The Commission’s Staff filed a timely response opposing the application to intervene, arguing that Mr. Hall has not stated an interest different from that of the general public. Mr. Hall replied to that response, contending that he does have a unique interest in the case.
In considering the application to intervene out of time, the Commission needs to learn more about the circumstances surrounding the application to be able to decide whether Mr. Hall has established a proper justification for intervention. The Commission expects to learn much more at the local public hearing. Therefore, the Commission will defer ruling on Mr. Hall’s application to intervene out of time until after the local public hearing.
