NOTICE
OF NONACTION ON LATE FILING
Issue Date: July 18, 2014
On July 11, 2014, the Commission
issued an order denying Mr. Mershon’s Motion
to Extend Time to File the Preliminary Response to the Report and Order[1].
Nonetheless, on July 18th, Mr. Mershon filed his Preliminary Response to the Former
Regulatory Judge’s Report and Order. Mr. Mershon indicates that this is,
“only a preliminary response.” The Commission will not consider Mr. Mershon’s response,
since it was submitted a month late and after the Commission’s order on his
application for rehearing[2].
The Commission issued its Order Denying Application for Rehearing
on July 2nd. Therefore, by statute, Mr. Mershon has thirty days from
his receipt of the order denying his application for rehearing to file a notice
of appeal. Neither Mr. Mershon’s Preliminary
Response to the Former Regulatory Judge’s Report and Order nor any future
response will extend the thirty days deadline for Mr. Mershon to file a notice
of appeal of the Commission’s Report and
Order.
A copy of section 386.510 of the
Missouri Revised Statutes − which
sets the deadline and procedure for pursuing an appeal of the Commission’s Report and Order with the appellate
court − was mailed to Mr. Mershon with the Commission’s July 11th
order.
The Commission hereby provides notice
that no action will be taken by the Commission on Mr. Mershon’s July 18th
Preliminary Response to the Former
Regulatory Judge’s Report and Order.

Mershon’s Preliminary Response to Mr. Daniel Jordans Report and Order
[sic].
[2] On June 4, 2014, the Commission granted Mr. Mershon’s request for additional time and set the deadline for him to file a response for June 18, 2014; later than he requested in his motion. The Commission then did not rule on the application until July 2, 2014, which essentially provided Mr. Mershon additional time in which to file his response.
