On August 24, 2012, the Staff of the Missouri Public Service Commission filed a complaint against Cedar Green Land Acquisition, L.L.C. and Gary F. Myers. On August 20, 2013, Staff filed a Motion to Dismiss with Prejudice, which stated that the resolution of File Nos. SA-2013-0354 and WA-2013-0017 involving applications for certificates of convenience and necessity has also resolved the issues raised by the complaint. Staff requests that the Commission dismiss the complaint with prejudice.
Commission Rule 4 CSR
240-2.116(1) states that a complainant may dismiss a complaint without an order
of the Commission before prepared testimony or oral evidence has been
offered. The parties have not offered
prepared testimony or
oral evidence. The Commission, therefore, will take notice of Staff’s dismissal. This case shall be closed.
