FISCAL NOTE REVIEW MEMORANDUM

The rules amended, rescinded, and adopted in this case set forth the Commissionís practice and procedure requirements.The Commissionís Order of Rulemaking appeared in the Sept. 15, 2011 Missouri Register, Volume 36, Number 18, amending, adopting, and rescinding rules in 4 CSR 240-2, and was effective on October 30, 2011.

Section 536.200.2, RSMo 2000 requires agencies to make a filing with the Secretary of State if, at the end of the first full fiscal year after implementation, the cost of the rule to all affected entities exceeds the agency estimate.The first full fiscal year after the rule became effective was the fiscal year beginning July 1, 2012 and ending June 30, 2013.

The Commission conducted a review of the fiscal estimate due to the amended rules in 4 CSR 240-2, and has determined that no fiscal estimate change need be filed with the Secretary of State.
