NOTICE REGARDING DATA REQUESTS

The Commission opened this case on March 20, 2013, to facilitate the Commission’s response to a request from a member of the Missouri General Assembly to investigate and report regarding pending legislation that would modify ratemaking procedures for Missouri’s electric utilities, particularly as related to recovery of infrastructure investments.  Thereafter, on March 21, and again on March 22, the Missouri Industrial Energy Consumers (MIEC) submitted a first and second round of data requests directed to each of Missouri’s four investor-owned electric utilities seeking detailed background information. 

The use of data requests in Commission cases is governed by Commission Rule 4 CSR 240-2.090(2).  That rule states that “[p]arties may use data requests as a means for discovery.”  The rule then goes on to describe how “parties” to whom data requests are presented are to answer those requests.  Since this is not a contested case and the Commission has not joined as parties either MIEC or any of the electric utilities from whom MIEC seeks information, there is no legal basis for MIEC’s service of data requests on the electric utilities and those utilities are under no obligation to respond to those data requests.
