NOTICE OF DISMISSAL

On December 28, 2012, Summit Natural Gas (“Summit”) of Missouri, Inc., filed the above-referenced tariff. The tariff bears an effective date of January 29, 2013 but, by agreement of the parties, has been suspended until May 30, 2013.
On March 20, 2013, Summit filed a Notice of Withdrawal of Tariff Sheet and Motion for Leave to Dismiss Application. Summit explains that it wishes to withdraw its tariff and dismiss this matter, which would allow for a more economic use of its resources, as well as those of Staff and Public Counsel.
Summit has filed direct testimony. Commission Rule 4 CSR 240-2.116(1) states that once prepared testimony has been filed, an applicant may dismiss an action only by leave of the Commission, or by written consent of all the parties. Both Staff and Public Counsel have filed pleadings stating they do not object to Summit’s motion. The Commission, therefore, will take notice of the dismissal and will allow Summit to withdraw its tariff sheet. This case may be closed.
THE COMMISSION ORDERS THAT:
1. Summit Natural Gas of Missouri, Inc.’s Notice of Withdrawal of Tariff Sheet and Motion for Leave to Dismiss Application is granted.
2. Tariff Sheet No. JG-2013-0300 is withdrawn.
3. The remainder of the procedural schedule and the hearing is canceled.
4. This file shall be closed.
5. This order shall become effective immediately on issuance.
